Woman goes to Parliament over hubby’s lock-up death
KUALA LUMPUR: A mother of seven, M. Manimalai, wants an inquest into the death of her husband A. Gnanapragasam, who was found dead in a police lock-up earlier this month.
She said Gnanaprasagam, 53, a wireman, who was arrested on June 10 for allegedly breaking into a house in Sg Buloh, had never complained of illness to her or felt ill when he was alive.
“A few days after he was detained by the police, he was dead. Who is going to take care of us now?” she asked at the Parliament lobby here yesterday.
She was speaking to the press after handing over a memorandum to Deputy Home Minister Jelaing Mersat, accompanied by Bukit Lanjan assemblyman Elizabeth Wong and Subang MP R. Sivarasa.
Manimalai, 40, claimed that when she last visited her husband at the Damansara Damai police station, his right eye was bruised.
“He told me the police had beaten him up. He said he had complained to the magistrate about the beating but no action was taken,” she said.
A post-mortem by Universiti Malaya Medical Centre pathologist Dr Prashant Samberkar found that Gnanaprasagam died of “toxaemia secondary to spontaneous peritonitis” – poison in the blood from bacterial infection in the intestines.
Sivarasa said that although Manimalai would not dispute the findings of the post-mortem, she wanted to know why her husband had not been given care while in detention.
He said that under the Criminal Procedure Code, an inquest should be held immediately after a detainee’s death.
“However, in Malaysia, the inquest is usually held months or even years after the death. We want an inquest to be held immediately,” he said, adding that the probe into Gnanaprasagam’s death should be carried out by an independent body and not by the police.

Pada 16 Jun 2009, Jabatan Negara Amerika telah mengemukakan Laporan Penyeludupan Manusia 2009. Dalam laporan tersebut Malaysia telah disenarai-hitamkan dan diturunkan ke ‘tahap 3’ berbanding dengan tahun 2008 berada di ‘tahap 2’ senarai pemantauan.
Pendakwaan ini telah menjadikan Malaysia menjadi satu daripada lima negara ASEAN yang disenarai-hitamkan yang setaraf dengan Cuba, Burma, Zimbabwe dan Fiji. Dalam laporan tersebut mendakwa bahawa Malaysia menjadi destinasi dan negara transit bagi penyeludupan wanita dan kanak-kanak untuk tujuan perdagangan seks dan penyeludupan lelaki, wanita dan kanak-kanak untuk dijadikan buruh paksa.
Richard Lugar, Senator Amerika turut memberi dakwaan yang sama bahawa kegiatan pemerdagangan manusia di Malaysia melibatkan pegawai kerajaan. Walaupun pelarian-pelarian telah didaftarkan di bawah United Nations High Commissioner for Refugees (UNHCR) turut dibawah ke Sungai Golok, Thailand dan Padang Besar, Malaysia untuk kegiatan perdagangan.

Kerajaan dan Kementerian berkenaan harus menubuhkan Suruhanjaya Siasatan Bebas yang melibatkan pelbagai pihak termasuk Badan-badan Bukan Kerajaan dan wakil-wakil rakyat supaya menunjukkan siasatan yang lebih telus di peringkat antarabangsa supaya memulihkan imej negara dan seterusnya mengembalikan kedudukan yang lebih tinggi.
Atas perkara yang tertentu ini yang melibatkan kepentingan rakyat umum yang perlu disegerakan, saya mohon usul ini dibincangkan.

International Entertainment Zone
Plans afoot to declare Bdr Utama area International Entertainment Zone

RESIDENTS of Bandar Utama are concerned about the impact on traffic and environment should the housing estate’s commercial area be declared an International Entertainment Zone.
During a meeting with Subang MP R. Sivarasa on Sunday at the BU3 Community Hall, residents said while the move proposed by the developer might stimulate foreign investment to counter the current economic slowdown, it would also worsen the area’s traffic congestion.
“Traffic congestion is becoming more serious especially after the link connecting Bandar Utama and Kota Damansara was opened recently. It will be a real problem to have an International Entertainment Zone here without the presence of a proper traffic dispersal system,” said resident Lai Wing Fatt from BU3.
“Since the link was opened, residents have to leave home an hour earlier than before to reach their work place on time,” he said, adding that they were also worried about the extended business hours that would affect the living quality in the area.
He said residents were earlier invited by the developer, Bandar Utama Development Sdn Bhd, to a briefing where they were told that the company had urged the state to declare the housing estate’s commercial area popularised by 1 Utama shopping centre as an International Entertainment Zone.
In line with that, the developer had also laid out a series of expansion including creating another 1,000 underground parking bays, he said.
He added that Jalan Dataran Bandar Utama was always congested during peak hours as the road was also used by parents sending their children to a school here that had 2,300 pupils.
Other residents suggested installing traffic lights and drawing yellow boxes among other measures to alleviate the problem. They also said the current traffic dispersal system facilitated shoppers and traders but had neglected residents.
Many also complained that the Petaling Jaya City Council (MBPJ) had not attended to their simple requests such as cleaning drains, adding street lights and building road humps promptly.
The accident-prone tunnel to access and exit Mutiara Damansara from the LDP and the status of the orang asli residing in the Desa Temuan apartments who have yet to receive strata titles were among the matters brought up.
Sivarasa will be meeting his constituents in a series of 30 meetings; Bandar Utama was the third location while the next will be on June 20 at Bandar Sri Damansara and at Ara Damansara on June 21. note: (these two dialogue sessions have been postponed)
He said he would request for the developer and MBPJ to listen to the people’s views and act accordingly, while he would facilitate the meeting.
“Petaling Jaya needs a macro- traffic plan as it has been overdeveloped. Many more projects were approved previously and most of them are half built,” he said.
“We were also shocked to find out that the draft Petaling Jaya Local Plan 2 was put forward without proper study on the traffic impact and water run-off.
“We need to address ad hoc planning’ and that is why we make sure public hearings are held before new projects are approved,” he added.
He said the inadequate provision of non-Muslim cemetery, worship places as well as vernacular schools were among the major issues he was looking into.

On the way home on Wednesday (10 June) 53 years old Ganapragasam was detained by the police for the investigation for theft.Only the following day when he was taken to court for remand order, his wife was informed about the nature of his arrest. According to his wife, she saw bruises on his face.Ganapragasam told the magistrate that he was assaulted by the police while in their custody. However, on the 14 June (Sunday), the wife of the deceased was told to be at the mortuary of University Hospital.No one was allowed to view the corpse except for his wife, not even his teen-age children. The next-of-kin, politicians and friends gathered at the compound of the mortuary waited for Ganapragasam’s wife with anxiety.She related that she was only allowed to view her husband’s corpse which was tilted sideway with visible bruises. Other than looking at what her eyes were allowed to see, she was even disallowed to touch her husband’s body. The vital question is, WHY?

PKR endorses the Selangor Government’s setting up of an Audit Committee to monitor waste management contract
Parti Keadilan Rakyat endorses the Selangor government’s effort to set up an audit committee to monitor the implementation of waste management contracts and steps taken towards a more transparent and accountable tender system for future contracts.
However, Keadilan is also mindful that over the years, contracts have been monopolized by a handful of UMNO-BN linked class F contractors.
In order to redress the past gross imbalance, Pakatan Rakyat have called for any contractors irrespective of party affiliation, including those who have previously been denied access due to the monopolistic direct appointment system, to apply for these contracts.
Therefore any contractors can put forward their applications through the various channels including the offices of Pakatan Rakyat, MPs and Aduns.
No contractors will be required to make any form of payment either at this point or any point thereafter for the purpose of forwarding such applications.Only contractors who are qualified, competent and genuine operators can apply and certainly not broking agents or shell companies. This move should not be perceived as condoning corrupt practices as it merely seeks to affirmatively restore the contract awarding system to a more level playing field by allowing better access to more and varied contractors.
Note however that any Pakatan Rakyat recommendations are still subject to the final decision making of Alam Flora due to the nature of the current contracts between Alam Flora and the Local Councils.
This process is transitional in nature and ultimately, the aim is to set up a fully transparent, accountable and merit-based process, in the future.KEADILAN reiterates its commitment to combat corruption and corrupt practices.

30% of PKR posts set aside for women
PKR will amend its constitution at a special congress to be held in Kajang on Saturday to enshrine democratic populism, presidential term limits, greater gender parity, and faster maturation of young leaders.
MCPX“All in all,” said vice-president Sivarasa Rasiah, chairman of the constitutional amendments committee, in an interview with Malaysiakini, “the thrust of the amendments is to facilitate members’ direct participation in the process of electing the leadership of the party.” This democratic populism will begin with a change in semantics: no longer will quasi-feudal terms be used to denote party structures so that a branch (formerly ‘cawangan’) will be called ‘ranting’, a division (previously ‘bahagian’) will be termed ‘cabang’, and the supreme council (‘majlis tertinggi’) will replaced by central executive council.
“In other words, we are opting for coinages that reflect our egalitarian ethos,” explained lawyer Sivarasa, a prominent member of the PKR and, by extension, the Pakatan Rakyat legal team tasked with litigating the many cases involving the opposition in the courts.
Egalitarian terminology paves the way for direct participation of each branch member in the election by secret ballot of leaders at the divisional level and the election by every divisional leader of the national leadership. “Thus we become the only party in the country that will elect its divisional leadership directly by branch members and will elect the national leadership by every member of the divisional leadership,” said Sivarasa. The current practice in most political parties in the country is for branches to elect delegates who will then elect the leadership of the divisions. The latter will nominate delegates to the general assembly of the party which will elect the national leadership of the party and its supreme council.
“The changes to the process of electing the divisional leadership, and from that point the national leadership, allow for more democratic participation in choosing leaders to helm PKR,” explained Sivarasa.
30 percent of post reserved for women
Term limits are meant only for the president who can hold the post for three consecutive three-year terms. The MCA are the only political party in the country with a similar limit on the presidential term of office.
Also, to reflect the growth in the size of the party’s membership and its spread over almost the entire Malaysian nation, the present five vice-presidential slots – three elected and two appointed – will be increased to seven – four elected and three appointed.
Presently, PKR has a membership of nearly half of million. To recognise the contributions of women and to boost gender parity, 30 percent of all posts in the party, from branch to national leadership, are reserved for women. This will not affect the women’s wing of the party which will continue to be operated and helmed by women.
“One must see the party which was set up a decade ago as a work in progress such that the allocation of thirty percent of the posts to women as a measure to encourage women’s participation and boost the growth of women leaders,” Sivarasa asserted.
To boost the youth wing, the party will reduce the upper limit of eligibility to 35 years of age from the present 40, to “conform to the international convention on the definition on youth”, said Sivarasa.
He said the changes overall were to help streamline the administrative and disciplinary procedures of the party so that it can function as an effective and transparent political entity.

RESIDENTS in Taman Puteri Subang are concerned about their safety and those of the motorists who ply the roads in their housing area due to the faulty streetlights in the Shah Alam neighbourhood.
According to residents association committee member Ong Kong Soon, most of the streetlights along Persiaran Galaksi, as well as several along Persiaran Angkasa and Jalan Sungai Buloh, have been faulty for the past six months.
“Each time I lodge a complaint with the Shah Alam City Council (MBSA), one or two streetlights would be repaired, but not the others,” said Ong.
Residents association chairman Mohd Khairy Buyong said there had been frequent accidents and snatch theft cases due to the poor visibility on the roads.
In the dark: Residents said there was an urgent need to repair the streetlights to reduce accidents and snatch thefts.
“There would be an accident at least once a week, mostly involving motorcycles.
“I’ve been informed of schoolchildren having their bags snatched in the early morning or evening.
“The vehicles also travel quite fast, especially from Persiaran Galaksi heading towards Jalan Sungai Buloh, where there is a slope and a bend,” he said.
Khairy said the reflective strips on the roads and the paint on the speed breakers had faded over time, making it more dangerous for motorists.
In addition to repairing the street- lights and reflective strips, he suggested that the MBSA place more speed breakers, as well as traffic lights at the Persiaran Galaksi and Persiaran Angkasa junction.
MBSA public relations officer Shahrin Ahmad said the streetlights were faulty due to an underground cabling problem.
“Repair work for the streetlights along Persiaran Angkasa are being carried out right now, and are expected to be completed by the end of this month.
“We are also looking for a contractor to repair those along Persiaran Galaksi,” he said.
On the faded reflective strips and paintwork, Shahrin said he would get the relevant department to check on the matter and get them repaired if necessary.

In addition to repairing the street- lights and reflective strips, he suggested that the MBSA place more speed breakers, as well as traffic lights at the Persiaran Galaksi and Persiaran Angkasa junction.
MBSA public relations officer Shahrin Ahmad said the streetlights were faulty due to an underground cabling problem.
“Repair work for the streetlights along Persiaran Angkasa are being carried out right now, and are expected to be completed by the end of this month.
“We are also looking for a contractor to repair those along Persiaran Galaksi,” he said.
On the faded reflective strips and paintwork, Shahrin said he would get the relevant department to check on the matter and get them repaired if necessary.

THE Public Works Department (JKR) has to obtain a planning approval from the Petaling Jaya City Council for the shelter complex being built in Damansara Damai.
The MBPJ organised a meeting between the JKR and Armanee Condominium residents at the MBPJ headquarters in Jalan Yong Shook Lin to clear the air about the ongoing project following complaints by residents.
The contractors for the 2.4ha project had initially defied two stop-work orders issued by the council in March and May.
Councillor Robert Tan, who chaired the meeting, advised the two parties to voice their concerns and sort out differences before the matter was brought to the One-Stop-Centre (OSC) committee meeting on June 10.
According to a JKR architect, who declined to be named, the JKR project involved building a shelter complex for the Women, Family and Community Development Ministry with hostel blocks, staff quarters and an administration block.
Armanee Condominium Residents Association chairman Sebastian Oh said the heavy vehicles plying the residential roads posed a danger to residents in the area.
Fellow resident Aili Hashim said they were not opposing the project but the heavy vehicles had left their roads in a deplorable state and that lorries moved in and out as early as 7am and as late as 10pm.
Oh said noise pollution was also a problem as construction work went on until late at night and even on weekends.
The JKR architect denied the claims of residents, saying that the contractors did not work past 5pm and that there were several other construction projects going on in that area.
“We also usually submit building plans for all our projects but, for this one, we were told by the council that we did not need a planning approval,” she said.
JKR Petaling district engineer Abdul Latif Moktar said he had to approve any work done after 5pm and he had not done so for this project but residents insisted that they had proof.
Another matter discussed was the possibility of opening a road through the project that would connect Damansara Damai to Bandar Sri Damansara.
A Women, Family and Community Development Ministry representative said they could consider surrendering the land needed for the road if MBPJ would bear the cost of building it.
Councillor Chan Chee Kong said the stop-work order would only be lifted once the development order has been issued.

Questions for Parliament - June 209 Session
The following are questions that have been submitted for answers by the relevant ministers at the next session of Parliament scheduled to start on the 16th June.
Members of Parliament have to submit their questoions to the secretariat three weeks before the start of the session. These questions will be organised and put up to be answered by the minister during question time.
The input for these questions were received from concerned residents in the Subang Parliamentary Constituency.
We would like to say thank you to all who responded and for taking the trouble to be a part of our nation's democratic process.

1. Tuan R. Sivarasa [Subang] meminta Menteri Kerajaan Tempatan dan Perumahan menyatakan apakah rancangan yang sedang dan akan diambil oleh kementerian untuk mengatasi masalah pengurusan kediaman berstrata khasnya di pangsapuri kos rendah yang timbul akibat Akta 663 yang diperkenalkan dalam tahun 2007.
2. Tuan R. Sivarasa [Subang] meminta Menteri Dalam Negeri menyatakan apakah langkah-langkah yang akan diambil untuk memastikan nisbah anggota polis di Daerah Polis Gombak dan Petaling Jaya di Selangor adalah 1:250 iaitu nisbah yang disyorkan oleh INTERPOL.
3. Tuan R. Sivarasa [Subang] meminta Menteri Pendidikan menyatakan apakah jumlah sekolah mengikut kategori-kategori sekolah rendah/menengah - Sekolah Kebangsaan, Cina, Tamil dan Ugama dimana jumlah murid untuk satu sessi ( pagi atau petang ) telah melebehi jumlah yang disyorkan iaitu 1500 murid, dan seterusnya, jumlah sekolah mengikut kategori yang telah melebehi purata 30 murid se kelas.
4. Tuan R. Sivarasa [Subang] meminta Menteri Pendidikan menyatakan sebab-sebabnya kerajaan tidak ambil langkah termasuk mengatur pembukaan sekolah tambahan atau baru, untuk pastikan di sekolah SJK( C ) Desa Jaya, Kepong Selangor, jumlah murid tidak sampai ke 4976 dan 40 murid se kelas saperti sekarang.
5. Tuan R. Sivarasa [Subang] meminta Menteri Dalam Negeri menyatakan kenapa tidak apa sebarang tindakkan atas lapuran polis yang telah dibuat oleh Datuk Seri Anwar Ibrahim pada 20hb Februari 2009 di Balai Polis Damansara yang menuduh Tan Sri Gani Patail, Tan Sri Musa Hassan dan ACP Koh Hong San adalah terlibat dalam pembuatan satu lapuran polis palsu berkaitan dengan tangkapan Datuk Seri Anwar oleh ACP Koh pada pukul 9 malam 20hb September 1998
6. Tuan R. Sivarasa [Subang] meminta Menteri Sumber Asli dan Alam Sekitar menyatakan apakah tindakkan-tindakkan yang akan dilakukan supaya kedudukan Malaysia di dalam Climate Change Performance Index 2009 naik daripada kedudukan sekarang iaitu 52 daripada 57.
7. Tuan R. Sivarasa [Subang] meminta Menteri Kerjaraya menyatakan kenapa National Slope Master Plan yang telah dijanji akan diisiap dan dikuatkuasakan pada tahun 2008 untuk menjaga keselamatan cerun-cerun di Malaysia dan memantau pembangunan di cerun-cerun masih tidak di umumkan.
8. Tuan R. Sivarasa [Subang] meminta Perdana Menteri menyatakan, sama ada kertas siasatan SPRM yang lengkap untuk lapuran polis Datuk Seri Anwar Ibrahim bertarikh 1hb Julai 2008 terhadap Tan Sri Gani Patail dan Tan Sri Musa Hassan telah diberi kepada panel tiga hakim bersara termasuk lapuran perubatan bertarikh 26hb October 1998 yang direka oleh Dr. Abdul Rahman Yusof bersama dengan Tan Sri Gani Patail.
9. Tuan R. Sivarasa [Subang] meminta Menteri Kewangan menyatakan samada kerajaan ada rancangan untuk mengarahkan institusi-institusi kewangann dalam negara memastikan satu bahagian minima yang tetap pinjaman mereka ditujukan kepada pengeluaran bahan makanan dan pertanian.
10. Tuan R. Sivarasa [Subang] meminta Menteri Dalam Negeri menyatakan berapakah warga Africa dibenarkan masuk ke Malaysia untuk tahun- tahun 20005, 2006, 2007, 2008 dan untuk tempoh 1hb Jan 2009 hingga 31hb Mei 2009 dan daripada jumlah ini berapakah masuk sebagai penuntut institusi pengajian tinggi dan sebagai pelawat. Seterusnya, apakah anggaran untuk tahun-tahun tersebut untuk jumlah warga Afrika yang ada di Malaysia tanpa kebenaran sah, dan adakah anggaran purata untuk tempoh berapa lama warga Afrika menetap di Malaysia, samada sah atau tidak sah.
