Anwar Ibrahim's Health.

MEDIA STATEMENT BY SIVARASA RASIAH, MEMBER OF PARLIAMENT FOR SUBANG ( PARTI KEADILAN RAKYAT ) AND LAWYER FOR ANWAR IBRAHIM – 16th November 2015

HEALTH MINISTRY’S STATEMENT ON ANWAR’S HEALTH IS STATING FALSE FACTS

The recent statement by the Health Ministry on Datuk Seri Anwar Ibrahim’s (DSAI) health issued by an unknown official and reported by Bernama on 6th November 2015 contains some serious misrepresentations which need correction.

The Ministry statement starts by asserting that DSAI’s shoulder injury was sustained prior to his detention.  No one has ever contended otherwise. DSAI did suffer his injury about two years prior to his detention and has been managing it with conservative treatment being physiotherapy, analgesics and supplements.  What we have been saying is that the injury was worsened by the terrible conditions he was made to endure during the first three weeks of this detention and his pain and discomfort is persistent up to date because of denial of recommended regular and intensive physiotherapy.

The Ministry statement then gives the false impression that a panel of doctors had recommended “exercises” which would be taught by a physiotherapist and to be performed daily in prison by the patient followed by a regular review and that this “was a standard therapy”.
The statement then suggests that the doctors had never recommended intensive physiotherapy.  These are shocking, irresponsible and false statements. They are contradicted completely, firstly, by the written reports provided by the panel of doctors who saw DSAI in February and, secondly, by the kind of treatment provided by them to DSAI when he was finally admitted in HKL in June and in July for about 4-5 days each time.

The  report dated 10.7.2015 by Dr Arshad bin Puji ( Sports Physician from HKL ) confirms that prior to detention, DSAI opted for “conservative treatment such as physiotherapy with physical and electrical modalities, and analgesia to control the pain”.  He confirms that whilst being hospitalized ( in June and July ), DSAI underwent “serial physiotherapy sessions consisting of physical modalities, electrical modalities, functional modalities, and taping application”. In simple language, DSAI underwent daily intensive physiotherapy sessions in hospital from which he experienced a favourable outcome. Dr Arshad concluded his report by saying “ At present, conservative management is the most suitable medical management for his right shoulder problems”.

Another comprehensive report  given by Dato Dr Fazir bin Mohamad, Senior Consultant Orthopaedic Surgeon, HKL dated 13th July 2015 was also  written after DSAI’s second hospitalization.
His report starts by saying that he and other doctors examined DSAI in prison on 24th February 2015.  He says that after diagnosing the injury as “Chronic Rotator Cuff Injury”, prescribed treatments were physiotherapy to gain back motion, analgesics, and ointment and plasters.  Regrettably such physiotherapy although prescribed by the doctors was denied to DSAI because of Datuk Dr Jeyaindran Sinnadurai until he was hospitalized in June.

Dato Dr Fazir then confirms that after DSAI was hospitalized in HKL from 2nd to 5th June, he was “given a daily physiotherapy and he responded positively with the treatement until he was discharged on 5th June 2015”.
Dr Fazir then says after a review on 25th June 2015 in prison, DSAI was hospitalized again in HKL on 7th July “continue his physiotherapy treatment while in the ward”.  DSAI did receive daily intensive physiotherapy again from which he received much benefit.

The dishonesty in the Ministry statement that intensive physiotherapy was not recommended is clear. The orthopedic doctors  have recommended physio from the outset and did in fact provide daily and intensive physio to DSAI during his brief hospitalizations.

We hold Datuk Dr Jeyaindran Sinnadurai, the head of the panel of doctors managing DSAI’s health, totally responsible for overriding the recommendations of the orthopedic specialists and denying DSAI regular and intensive physiotherapy from March until now.  All that has been done is that a physiotherapist has been sent to Sg Buloh prison 10 times to date to guide DSAI in doing some instructions in exercises for his shoulder as well as ultrasound treatment. This is wholly inadequate compared to the type of physiotherapy provided during his hospitalization which gave DSAI considerable benefit.
Independent orthopedic specialists have also concurred with the HKL doctors and said that “ daily intensive and appropriate physiotherapy will prevent rapid deterioration of the muscles of the torn tendons”.

The issue therefore is NOT about what surgical options are suitable for DSAI as is also falsely claimed in the Ministry statement.

The real issue is why is intensive physiotherapy which was provided during DSAI’s hospitalization as recommended by the orthopedic specialists being denied to him up to now, causing him much pain and discomfort and endangering his long term health.  Such denial constitutes a form of torture contrary to international law and human rights norms.

We demand that DSAI be taken to either hospitalized or be taken to hospital at least three times a week to receive this treatment. This was done during his earlier detention in 1998 to 2004 and there is no excuse for denying it to him now. 

It has also been recently promised in Parliament by Dato Zahid Hamidi in reply to YB Nurul Izzah; regrettably no treatment at all has been provided since that statement by Zahid ten days ago.
We ask the Health Ministry to remain professional and independent on this issue and also to be accountable for the statements that they make by naming the official making the statement in future.

Re: SPRINT Toll increase

Update on SPRINT Sdn Bhd  toll increase

SPRINT Sdn Bhd convened a special board meeting on 27th October 2015 to discuss the increase of toll rates which had already been implemented pursuant to a letter from Lembaga Lebuhraya Malaysia ( LLM) dated 6th October 2015. The meeting was convened at the request of the Menteri Besar of Selangor YAB Azmin Ali.

At the meeting which was attended by the Chairman of SPRINT Ir Haji Yusoff bin Daud, director Dato' Hj Azmi bin Mat Nor and myself, the SPRINT management presented the financial outlook for the company comparing the numbers with and without the toll increase.  What the numbers showed was that the Federal government was stopping the previous annual payment of about 90 million ringgit of compensation paid to SPRINT pursuant to the concession agreement which would now be collected from the highway users through increased toll rates.

I put on record the objection of the Selangor State Government, who is the majority shareholder of Kumpulan Perangsang Bhd who I represent on the SPRINT board, to the toll increase.  The position of the Selangor State Government is that given the current economic climate, a responsible government would manage the situation differently ie by maintaining the current toll rates and renegotiating the terms of the concession agreement in respect of the compensation payments.

Our objection could not change the final position taken by the board and management of SPRINT by virtue of the fact that Kumpulan Perangsang is only a minority shareholder holding only 20 percent of the shares of SPRINT which were invested during the time of the previous BN government in 1999. At that time Perangsang invested about 132 million ringgit in SPRINT. Since 1999 to date, no dividend returns have been paid to Perangsang.  No toll increases have been implement from 2001until the recent increase a few weeks ago.

By reason of the fact that a major policy decision has been taken which I am in principle opposed to, I am reviewing my position as a member of the board of directors of SPRINT.  I will consult with the other members of the board of Perangsang and also the Menteri Besar of Selangor before I make a decision.

Media Statement - Deepavali Bazaar

Media statement by Sivarasa Rasiah, Member of Parliament for Subang dated 18th October 2015.
“Some friendly advice for my friend YB Tony Pua”
From his recent Facebook postings I can see that my friend and colleague in Parliament, YB Tony Pua, member of Parliament for Petaling Jaya Utara seems quite upset, in particular, with two division level leaders of Keadilan from Kelana Jaya division naming them as “a Samy” and “a Murali” and calling them “gangsters” and “disgraceful thugs”. He also claimed that “this Samy and his gang ….charged exorbitant rentals to traders at the traditional site for the Deepavali bazaar in Sungei Way.
Tony also said that “a group of gangsters led by the same Samy and Murali” heckled him as he spoke to the Tamil press in front of the Easwari Temple in Sg. Way on Thursday. Having watched the videos of the incident  ( in particular the Kinibiz video ) and read the Malaysiakini accounts dated 15.10.2015 and talked to some of those present, it seems to me quite clear that the heckling started after the crowd present which  included  traders understood that Tony had just said to the media present that he was opposed to any bazaar at the original site in Sg Way village and,  second,  that the move to Easwary Temples area  was necessary to stop certain persons from committing extortion of the traders in the original site.
These unfortunate accusations are all arising out of a proposed relocation of the Deepavali bazaar traders in their original site in Sg Way village to the new site next to the Easwari Temple.  Tony and his assemblyman YB Lau Weng San are in favour of this move. Many traders are strongly opposed to it saying that it jeopardizes their earnings from their stalls.
My advice to both Weng San and Tony is that such matters are best left to the best judgment of the Datuk Bandar of Petaling Jaya and his councillors.  We should not interfere unless the decisions made at MBPJ  are clearly unreasonable or obviously wrong or against stated policies of the Pakatan coalition.
Tony and Weng San would also know that a majority of the MBPJ councilors have in fact already proposed to the Datuk Bandar a win-win solution where the Deepavali bazaar for Sg Way would be conducted,  for this year anyway,  at both the original site ( where it has run for 15 years at least ) and the new site near Easwary Temple ( as a trial run for evaluation ).  This would also be known to many of the traders involved.  Therefore, my advice would be, rather than make controversial public pronouncements on the matter, let us leave this to the Datuk Bandar of MBPJ and his councilors to resolve.
I also wish to point out that the DAP is now again in a formal coalition with Keadilan and Amanah, a move which we have all welcomed.  We must therefore manage complaints about one another ‘s members in the spirit of coalition building.  If there is evidence of wrong-doing, we should present it to the leadership of the party concerned.  I must make this clear - if there is evidence, Keadilan will not tolerate such misconduct and will take the necessary action.
However making unsubstantiated  serious allegations that extortion is taking place without specifics ( as was discernible in the video ) does not assist at all. Name calling aggravates the accused persons further. The video shows some of those present demanding evidence from Tony and for which there seemed to be no immediate response.  That has now resulted in those Tony accused and some other traders filing police reports at the IPD Petaling Jaya yesterday against Tony in defence of their reputation.   This is also an unfortunate development.
The Deepavali bazaar in the original site in Sg Way has been operating there for at least 15 years.  Since Pakaan took over from 2008, I am not aware of any specific complaints to MBPJ or police reports made by traders or others since 2008 alleging extortion of themselves by third parties.  Last Thursday appears to be the first time such allegations are being made in public to justify moving the bazaar.  If there is any such evidence implicating our members, then we would urge Tony to present it to the party.
Then, on Friday, certain DAP leaders organized a press conference  where one  Indian gentleman appears to be complaining that he has been prevented by from running his stall in the new site at Easwary Temple.  He also complained that Samy had prevented him from getting a stall in the original site.  Such allegations can and should be taken to MBPJ or even the police for them to investigate.  On the other hand, I am told that traders at the Deepavali bazaar original site who were  present at the IPD Petaling Jaya yesterday made statements to the media that they have no experience of any form of extortion and having to make exorbitant payments.
Keadilan will not tolerate any proven criminal conduct on the part of its members, especially the misconduct alleged by Tony that acts of extortion are being perpetrated. 
Keadilan regrets very much that Tony was subjected to the angry and rude statements that were hurled at him when he went to the Easwary Temple to do his press conference on Friday.  However as a experienced member of parliament regularly handling people’s grievances, I am sure that Tony would appreciate that people who perceive proposed changes as threatening their  meagre incomes can react emotionally and aggressively.  Some of these traders are having great difficulty understanding why Ton y and Weng San are insisting that the bazaar move to the new site when the  majority of the MBPJ councilors have now  proposed the win-win solution that it can operate in both sites.  When one insistently waves the proverbial red flag at an angry bull, it is naïve to expect the bull to sit patiently and watch.
My friend YB Pua has done sterling work ( and continues to do ) on critical national issues such as IMDB.  He should concentrate on those issues and leave more mundane  issues, like as in this case,  about  where a Deepavali bazaar should be located,  to the appropriate authorities to decide.
We have far bigger battles to fight.  We need to remove Prime Minister Najib and end the corrupt oppressive and inefficient rule of UNMO and BN.  Let us remain united and focused on that.

Sprint Toll Increase - Kenaikan Toll Sprint

PRESS STATEMENT RE SPRINT Highway toll increases dated 14th October 2015.

I have received many queries in social media as to whether I am on the board of SPRINT Sdn Bhd ( in full - Sistem Penyuraian Trafik KL Barat Sdn Bhd ) and whether I supported the toll increase as a member of the board.

These are the facts. I do sit on the board of SPRINT Sdn Bhd as a representative of Kumpulan Perangsang Selangor Bhd ( KPS) which owns twenty (20) percent of the shares of SPRINT. Gamuda Group owns the other eighty (80) percent.

The question of my support for the toll increase does not arise because the issue was never brought to a board meeting of SPRINT for discussion.  The SPRINT management have implemented the  toll increase pursuant to a letter received about a week ago from Lembaga Lebuhraya Malaysia ( LLM) informing them of several matters - that the Federal Government was not prepared to increase their compensation anymore, that SPRINT could increase their toll rates as specified in the letter and such increases must be announced by the company itself.  The toll increase was then announced. It was not referred to the board of directors by circular resolution or a meeting.

I am not in agreement with such an increase. Given the current state of the economy, this is the wrong time to further burden the people of Selangor and Malaysia with toll increases on top of the continuing increase in prices and GST.  My position is consistent with that of the Pakatan Selangor government headed by Menteri Besar Azmin Ali.

I am therefore writing to the Chairman of SPRINT, Ir. Hj. Yusoff  bin Daud to convene a special board meeting to discuss and review the matter. I have also reported the matter to  Menteri Besar Azmin Ali and will act on any further instructions given by him.

PERNYATAAN AKHBAR bertarikh 14hb Oktober 2015
Kenaikan kadar tol oleh SPRINT Sdn Bhd.

Saya telah menerima banyak soalan di dalam media sosial samada saya adalah ahli lembaga SPRINT Sdn Bhd ( nama penuh adalah Sistem Penyuraian Trafik KL Barat ) dan samada saya telah menyoking kenaikan tol sebagai seorang ahli lembaga pengarah.

Berikut adalah kenyataan.  Saya memang adalah seorang anggota lembaga pengarah SPRINT sebagai wakil Kumpulan Perangsang Selangor Bhd (KPS) yang merupakan pemilik dua-puluh peratus saham SPRINT. Kumpulan Gamuda memiliki baki lapan-puluh peratus saham.

Persoalan sokongan saya sebagai ahli lembaga pengarah untuk kenaikan tol tidak timbul langsung.  Isu kenaikan tol tidak pernah dirujuk kepada lembaga pengarah untuk dibincang.  Pengurusan SPRINT telah melaksanakan kenaikan tol menurut satu surat dariapda Lemabaga Lebuhraya Malaysia ( LLM) yang diterima seminggu lalu yang telah maklumkan, antaranya, saperti berikut - bahawa kerajaan Persekutuan tidak akan bayar lebih pampasan kepada syarikat, bahawa SPRINT boleh naik kadar tol selaras dengan kadar yang tertera dalam surat tersebut, dan syarikat bertanggung jawab untuk mengumumkan kadar kenaikan tol. Ekoran surat itu, kenaikan tol diumumkan oleh syarikat. Perkara itu tidak dirujuk sebelum itu kepada lembaga pengarah melalui pekeliling atau mesyuarat.

Saya tidak setuju dengan kenaikan tol yang telah diumumkan.  Memandangkan keadaan ekonomi sekarang, ini bukan masa yang sesuai untuk menambahkan beban atas rakyat Selangor dan Malaysia dengan kenaikan kadar tol bertambah kenaikan harga barang yang berterusan dan juga GST.  Pendirian saya, saya anggap, adalah selaras dengan pendirian Kerajaan Selangor Pakatan yang dipimpin oleh YAB Menteri Besar Azmin Ali.

Justeru, saya akan menulis kepada Pengerusi syarikat SPRINT, Ir Hj.Yusuff bin Daud untuk memanggil satu mesyuarat khas lembaga pengarah untuk membincang dan kajisemula perkara ini.  Saya telah juga melapurkan perkara ini kepada YAB Menteri Besar Azmin Ali dan akan melaksanakan apa-apa arahan lanjut daripada beliau.

1.Tuan R.Sivarasa [ Subang ] meminta  Menteri Sumber Asli dan Alam Sekitar dan/atau Menteri Luar Negara menyatakan usaha dan hasil pemerintah dalam menyelesaikan masalah jerebu yang dihadapi Malaysia pada peringkat serantau memandangkan Malaysia merupakan pengerusi ASEAN.

2.Tuan R.Sivarasa [Subang] meminta Menteri Tenaga, Teknologi Hijau dan Air menyatakan jumlah wang tenaga boleh diperbaharui (Renewable Energy Fund) yang telah dikutip daripada pengguna elektrik oleh Tenaga Nasional Berhad bagi pihak Sustainable Energy Development Authority (SEDA) bagi tahun 2012, 2013 dan 2014 dan jumlah yang telah dibayar kepada penjana solar categori individu bersama institusi  non-profit  ( agama, ngo dsbnya ).

4.Tuan R.Sivarasa [Subang] meminta Menteri Perushaan Perladangan dan Komoditi menyatakan sebab pihak FELDA membantah dan menghalang pengeluaran lesen menjual kelapa sawit oleh Lembaga Kelapa Sawit Malaysia kepada peneroka-peneroka FELDA yang sudah selesai semua hutang dan mendapat hakmilik tanah mereka.

5.Tuan R.Sivarasa [ Subang ] meminta Menteri Luar Negeri menyatakan samada Malaysia akan mendesak Sri Lanka menghormati dan melaksanakan sepenuhnya syor-syor Pejabat Pesuruhjaya Tinggi Hak-Asasi Bangsa-Bangsa Bersatu termasuk penubuhan satu mahkamah istimewa hyrid ( special hybrid court) untuk membicarakan kes-kes jenayah perang yang dilakukan  dari tempoh 2002 ke 2011.

Tuan R.Sivarasa [ Subang ] meminta Perdana Menteri menyatakan pandangan tentang pendedahan bahawa agensi-agensi kerajaan Malaysia termasuk Jabatan Perdana Menteri telah membeli spyware  bernama Remote Control System (RCS) melalui syarikat tempatan di Shah Alam, Selangor, bernama Miliserve Technology daripada pembuat spyware bernama Hacker Team di Milan, Italy, dan telah menggunanya untuk mengintip beberapa rakyat Malaysia.

7. Tuan R.Sivarasa [Subang[ meminta Perdana Menteri menyatakan rasional pemerintah menamatkan perkhidmatan Tan Sri Gani Patail sebagai Peguam Negara secara tergesa-gesa pada 27 Julai 2015 sedangkan beliau sememangnya akan bersara pada 6 Oktober 2015.

8.Tuan R.Sivarasa [Subang] meminta Perdana Menteri menyatakan apakah harta pusaka yang diwarisi oleh beliau yang dirujuk dalam kenyataan Jabatan Perdana Menteri kepada New York Times yang disebut dalam rencana bertajuk ” Jho Low, Well Connected in Malaysia, Has an Appetite for New York ” bertarikh 8hb Februari 2015.

9.Tuan R.Sivarasa [Subang] meminta  Perdana Menteri menyatakan samada beliau telah dihubungi oleh wakil-wakil kerajaan Amerika Syarikat berkaitan dengan siasatan ”Grand Jury” di sana dalam tuduhah-tuduhan amalan rasuah yang membabitkan Perdana Menteri sendiri dan dua orang lagi, Riza Aziz dan Jho Low;

10.Tuan R.Sivarasa [ Subang ] meminta Perdana Menteri menyatakan punca “dana keluarga” atau “family wealth” yang dikatakan digunakan oleh anak tiri beliau Riza Aziz untuk membeli hartanah mewah di New York dan Beverley Hills bernilai tidak kurang daripada 60 juta USD dan juga untuk melabur beberapa ratus juta USD dalam industri filem di US.

Kenyataan Media Bersama

Seruan kepada Ahli-Ahli Parlimen dari semua parti untuk bersatu dalam undi tidak percaya terhadap Perdana Menteri untuk menyelamatkan Malaysia.

Kenyataan Media Ahli-Ahli Parlimen KEADILAN bertarikh 23.8.2015

 

Kami, sebagai ahli-ahli Parlimen, adalah amat risau dengan tindakan-tindakan yang diambil kebelakangan ini untuk melemahkan demokrasi, kedaulatan undang-undang dan urus tadbir baik kerajaan (good governance) di negara kita, khususnya, cara bagaimana institusi-insitusi awam kita telah diserang dan diperalatkan untuk melindungi Perdana Menteri dari disiasat mengenai penglibatan beliau dalam skandal kewangan 1MDB, termasuk RM2.6bil yang didakwa dimasukkan ke dalam akaun bank peribadi Perdana Menteri.

Tindakan-tindakan di atas dan ketiadaan langsung ketelusan dan akauntabiliti dari pihak Perdana Menteri untuk menjelaskan sepenuhnya skandal kewangan 1MDB telah menggoyahkan keyakinan pelabur, memberi kesan negatif kepada Ringgit dan ekonomi secara keseluruhan, dan ini telah menyebabkan kesusahan kewangan kepada rakyat Malaysia.

Kami yakin bahawa jika penumpuan kuasa di tangan satu individu terus dibiarkan dan tidak dengan cepatnya dikembalikan kepada rakyat, Malaysia akan segera menuju ke arah menjadi satu negara diktator yang gagal.

Sebagai Ahli Parlimen, kita berkewajipan untuk mewakili kehendak dan suara rakyat, dalam menyokong penyingkiran Dato Seri Najib Razak sebagai Perdana Menteri dalam undi tidak percaya demi negara kita, untuk memulihkan demokrasi dan integriti moral dan kebebasan institusi awam kita.

Kami akan bekerjasama dengan semua Ahli Parlimen tanpa mengira parti mereka untuk menyokong undi tidak percaya terhadap Perdana Menteri atas empat syarat luas berikut:

1. Untuk segera membentuk kerajaan peralihan berdasarkan perkongsian kuasa antara pembangkang dan Barisan Nasional;

2. Kerajaan peralihan akan memulakan pembaharuan segera bagi memastikan pilihan raya yang bebas dan adil, media yang bebas, memperkukuh sistem demokrasi berparlimen, serta membentuk satu jawatankuasa ekonomi kecemasan untuk menangani kebimbangan Ringgit yang semakin lemah, GST, peningkatan kos hidup dan membasmi kroni kapitalisme;

3. Kerajaan peralihan hendaklah juga dengan segera menubuhkan Suruhanjaya Diraja yang bebas untuk membuat cadangan bagi memastikan bahawa Perjanjian Malaysia 1963 harus dihormati dan dilaksanakan sepenuhnya.

4. Kerajaan peralihan akan memanggil pilihan raya umum dalam dua tahun selepas pembentukan kerajaan peralihan untuk menamatkan kerajaan peralihan tersebut.

Call on MPs from all divide to unite in a vote of no-confidence against Prime Minister to save Malaysia.

Press Statement by KEADILAN MPs dated 23.8.2015

We, as Members of Parliament, are extremely alarmed by recent actions taken to undermine democracy, the rule of law and good governance in our country, in particular, the manner in which our public institutions have been subverted and used to shield the Prime Minister from being investigated concerning his involvement in the 1MDB financial scandal, including the alleged RM2.6bil which was deposited into the Prime Minister’s personal bank accounts.

The above actions and the total lack of transparency and accountability on the part of the Prime Minister to fully explain the 1MDB financial scandal has shaken investors’ confidence, negatively impacted the Ringgit and the overall economy, causing financial hardship to the people of Malaysia. 

We are convinced that if the concentration of power in the hands of one individual continues unchecked and not quickly reversed, Malaysia will be pushed towards becoming a dictatorship and a failed state.

As Members of Parliament, we are duty bound to represent the will and voice of the people, in supporting the removal of Dato Seri Najib Razak as Prime Minister in a vote of no-confidence for the sake of our nation, in order to restore democracy and the moral integrity and independence of our public institutions.

We will work with all Members of Parliament irrespective of their party to support a no-confidence vote against the Prime Minister upon the following four broad terms:  

1.             To immediately form a transition government based on power sharing between the Opposition and the Barisan Nasional;

 

2.             The transition government shall initiate immediate reforms to ensure free and fair elections, free media, strengthen our system of parliamentary democracy, as well as forming an emergency economic committee to address concerns on the weakening Ringgit, GST, increasing living costs and eradicating crony capitalism;

 

3.             The transition government shall immediately establish an independent royal commission to make recommendations to ensure that the Malaysia Agreement 1963 shall be honored and be implemented to its fullest effect;

 

4.             The transition government shall call for a general election to be held within two years after its formation to retire the transition government.

KENYATAAN MEDIA DS ANWAR IBRAHIM - Jangan musnahkan integriti institusi kita

Saya sempat bertemu Datuk Seri Anwar Ibrahim di Penjara Sg Buloh baru-baru ini dan beliau telah mengarahkan supaya kenyataan beliau seperti berikut disebarkan.

“Saya menggesa Perdana Menteri Dato’ Sri Najib untuk menghentikan segala tindakan mengganggu dan mengancam pegawai-pegawai siasatan agensi kawal selia negara. Saya merujuk secara khusus bagaimana anggota PDRM diguna untuk menangkap, menyoal siasat malah juga mereman anggota-anggota Suruhanjaya Pencegahan Rasuah Malaysia (SPRM), termasuk mereka yang terlibat di dalam siasatan bagaimana RM 42 juta wang rakyat melalui SRC International dimasukkan ke akaun peribadi DS Najib di AmBank.

Terdapat juga tanda-tanda bahawa Bank Negara, yang merupakan institusi kawal selia yang teramat penting, juga sedang diancam. Amatlah mustahak bagi negara dan keadaan ekonomi agar Bank Negara terus dilihat sebagai sebuah badan yang bebas, profesional dan berintegriti. Bank Negara wajib dibenarkan menjalankan tugas-tugas tanpa kekangan terutama di dalam aspek pengesanan dan pencegahan pengubahan dan aliran wang haram. Jika Bank Negara dilihat cuai dan tidak cekap menjalankan tugas akibat gangguan politik, maka ekonomi negara akan mengalami kesan yang amat serius.

Rakyat Malaysia perlu bersatu dalam memberi sokongan terhadap SPRM dan Bank Negara untuk menjamin institusi-institusi ini selamat dari gangguan politik.

Saya menggesa agar semua rakyat Malaysia, Ahli-Ahli Parlimen dari semua parti, NGO dan masyarakat sivil mengetepikan perbezaan dan bersatu untuk menyelamatkan negara kita dari krisis politik dan ekonomi yang melanda kita sekarang.”

Perutusan khas Dr Wan Azizah Wan Ismail


Alhamdulillah, pertamanya saya memanjatkan rasa syukur yang tidak terhingga kepada Allah SWT, di atas kurnia-Nya, memberi kemenangan kepada calon KEADILAN bagi Pilihan Raya Kecil P.44 Permatang Pauh yang berlangsung hari ini, 7 Mei 2015.

Kemenangan hari ini adalah bukti bahawa rakyat, khususnya pengundi-pengundi di Permatang Pauh, mahukan sebuah Pakatan Rakyat yang kuat.

Kemenangan ini, bukan hanya kemenangan KEADILAN sahaja. Tetapi ianya adalah kemenangan rakyat, yang menentang kezaliman Barisan Nasional terhadap Saudara Anwar Ibrahim dan ianya merupakan suatu referendum rakyat menolak pelaksanaan Cukai Barangan dan Perkhidmatan (GST), penentangan terhadap rasuah dan salahguna kuasa.

Dalam Pilihan Raya Kecil ini, kita menyaksikan peningkatan undi kepada KEADILAN sekitar 4 hingga 5 peratus daripada kalangan masyarakat Melayu, khususnya anak-anak muda.

Ternyata pemenjaraan bermotifkan politik oleh Barisan Nasional terhadap Saudara Anwar, menzahirkan simpati yang tinggi dan ianya adalah bukti bahawa beliau masih relevan kepada rakyat.

Menerusi Pilihan Raya Kecil ini menterjemahkan manifestasi kepada kekecewaan rakyat terhadap kelemahan dan kegagalan Perdana Menteri, Datuk Seri Mohd Najib Tun Razak, dipenuhi dengan pelbagai ketirisan, kemewahan pemimpin dan pelbagai skandal, terutamanya skandal 1MDB, yang terkini terpaksa menggunakan dana dari Tabung Haji.

Pilihan Raya Kecil ini adalah pencetus dan pemberi inspirasi kepada sebuah gerakan rakyat yang lebih besar untuk menuntut suatu perubahan yang total, bagi mengembalikan negara ke landasan yang betul.

Di kesempatan ini juga saya ingin mengucapkan terima kasih dan tahniah kepada seluruh kepimpinan serta pendukung Pakatan Rakyat, daripada KEADILAN, PAS dan DAP yang sejak awal-awal lagi bertungkus lumus membantu kita memenangi pilihan raya ini.

Walaupun saya, Saudara Anwar dan KEADILAN difitnah menerusi media arus perdana setiap hari, walaupun mereka berusaha sedaya upaya memburukkan prestasi saya di Kajang, walaupun mereka berusaha bersungguh-sungguh untuk memecah belahkan kesatuan kita dengan pelbagai isu, namun ternyata segala tohmahan mereka tidak berkesan.

Terima kasih kepada pegawai SPR dan polis yang bertugas untuk memastikan Pilihan Raya Kecil ini berjalan lancar.

Bagi pihak KEADILAN, insya Allah segala isu dan permasalahan yang dibangkitkan oleh rakyat sepanjang Pilihan Raya Kecil ini, akan kami tangani seberapa segera. Untuk itu juga kita berterima kasih kepada Ketua Menteri Pulau Pinang yang sudah membuat pengumuman untuk membantu kita di Permatang Pauh ini.

Terima kasih rakyat Permatang Pauh yang sudi menerima Kak Wan untuk kembali berbakti. Reformasi! Hidup Rakyat!

Sivarasa - per: MH370

Terima kasih Tuan Yang di-Pertua dan Yang Berhormat Menteri.
Saya balik kepada tindakan yang tidak dibuat oleh DCA pada malam itu. Daripada laporan dan antara fakta kita ada sekarang, kita tahu pada 1.21 pagi hari itu, radar signal yang nampak di dalam skrin DCA tersebut terhilang dalam skrin itu.

Kalau ini berlaku di tempat lain, maksudnya reaksi yang akan dibuat adalah serta-merta sebab bila signal itu terhilang, itu menunjukkan satu yang sangat serius telah berlaku. Pesawat itu telah terhempas ataupun sesuatu yang amat serius.

Contoh saya bagi, satu air crash Egypt Air Flight 990 pada tahun 1959. Dia take-off daripada New York, 200 kilometer di Atlantic Ocean. Radar signal yang ada terhad di dalam skrin terhilang, cara yang sama tetapi dalam kes itu, apabila kita baca laporan- laporan berkenaan di situ, dalam beberapa minit search and rescue sudah mula sebab controller semua orang yang faham, begitu seriusnya apabila signal itu terhilang dalam skrin.

Jadi soalan saya ialah apakah siasatan yang telah dibuat oleh kerajaan setakat ini dan ini berkaitan juga dengan soalan kenapa tidak ada hubungan dengan military, kenapa military tidak berhubung dengan DCA pada malam itu.

Apakah siasatan yang telah dibuat? Bagi saya siasatan ini kita tidak perlu orang antarabangsa. Inilah agensi-agensi kita. Inilah MAS operation center, DCA dengan military. Bukan isu tentang berkaitan dengan black box dan apa-apa yang berlaku di lautan Indian Ocean dan sebagainya.

So, soalan saya ialah, adakah siasatan yang dibuat dan bolehkah kerajaan tubuhkan satu badan bebas, buat siasatan rapi terhadap isu ketiga agensi ini apakah, yang berlaku untuk 5 hingga 6 jam yang pertama. Itu saja.

Sebab kita tahu kalau kita pergi kepada search itu, itu jauh lebih besar tapi isu itu saja. Kenapa pada 4 hingga 5 jam yang pertama, sebab itu sangat kritikal, tiga buah agensi ini secara berasingan tapi semua sudah gagal buat tanggungjawab mereka. MAS operation center ada gambaran yang salah dan macam mana mereka dapat tahu itu di Cambodia, itu pun salah, itu pun perlu disiasat.

DCA kenapa bila radar signal hilang tidak ambil apa-apa tindakan serta-merta dan military. Adakah kerajaan telah buat siasatan ini ataupun bagi saya, saya ingin cadangkan kerajaan tubuhkan Royal Commission atau Badan Bebas dan satu siasatan terbuka dan bagi tahu rakyat Malaysia dan juga keluarga-keluarga penumpang pesawat itu dan krew apakah sebenarnya yang berlaku pada malam itu.

Polis wajib siasat kes G.Thiyaggurudeen – jangan cuci tangan saja

Saya kecewa dengan keputusan Ketua Polis Negeri Sembilan (KPN), DCP Jaafar Mohd Yusof untuk tidak meneruskan siasatan ke dalam kes G.Thiyaggurudeen atas alasan ‘ia terlalu rumit’ (it’s complicated) seperti yang dilaporan di Malaysiakini pada 24hb Mac 2015. Reaksi polis tersebut telah menunjukkan sikap yang kurang profesional dan ketidakinginan polis untuk mendalami kes yang kompleks.

Dakwaan yang diketengahkan oleh ayah G.Thiyaggurudeen, En Ganesan Suppayah adalah serius. Pada 13.2.2015 G.Thiyaggurudeen telah dibawa keluar daripada Sekolah Menengah Kebangsaan Raja Jumaat, Port Dickson oleh dua orang guru tanpa kebenaran pentadbir sekolah dan ayahnya. G.Thiyaggurudeen juga telah dipaksa untuk untuk membuat laporan polis terhadap ayahnya S.Ganesan bahawa ayahnya telah memaksa beliau untuk keluar dari agama Islam dan memeluk agama Hindu serta memukulnya. G. Thiyaggurudeen juga dipaksa untuk minum air penawar. G.Thiayggurudeen juga  dikurung dalam sebuah bilik di Pusat Dakwah Islam Paroi dan disoal siasat selama 3 jam 30 minit oleh 8 orang pegawai Pusat dakwah Islam Paroi dengan cara yang telah menakutkan dia.

Selepas insiden tersebut, G.Thiyaggurudeen yang berumur 14 tahun mengalami trauma dan tekanan emosi yang kuat yang menyebabkan beliau minum racun paraquat dalan percubaan membunuh diri. Sewaktu beliau diberikan rawatan di hospital, Pegawai-pegawai Pusat Dakwah Islam Paroi sering mengganggu beliau sehingga ayahnnya terpaksa bawa keluar beliau dari hospital sebelum rawatan disempurnakan. S.Ganesan dan G.Thiyaggurudeen telah membuat lima laporan polis berkenaan dengan kes ini tetapi sehingga kini tiada  tindakan diambil terhadap mana-mana pihak.

Parti Keadilan Rakya memandang berat kes ini sebagai satu isu kepentingan awam. Hari ini, pihak En Ganesan telah melalui peguamcara beliau, telah menghantar satu surat kepada KPN Negeri Sembilan untuk mendapat penjelasan tentang status siasatan kes ini. KPN Negeri Sembilan perlu memberi penjelasan, kenapa polis belum merekodkan percakapan  pengadu –pengadu dalam kes ini dan bagaimana KPN Negeri Sembilan dapat membuat kesimpulan bahawa kes ini adalah rumit atau ‘complicated’ tanpa siasatan dilakukan? Jika KPN Negeri Sembilan gagal memberi penjelasan dalam masa 2 minggu, kami akan bawa kes ini kepada Bukit Aman dan juga badan-badan lain untuk menuntut keadilan. Akhirnya kalau tidak ada apa-apa tindakan, tindakan undang-undang di mahkamah akan dimulakan.
Ahli Dewan Undangan Negeri Port Dickson, YB  M. Ravi akan membantu mencari keadilan untuk keluarga ini dengan memohon satu temu janji bersama EXCO Negeri Sembilan berkaitan dengan portfolio agama dan kebajikan dan/atau Menteri Besar Negeri Sembilan supaya arahan boleh dikeluarkan kepada Jabatan Agama Islam Negeri Sembilan menghentikan semua gangguan yang dilakukan terhadap G.Thiyaggurudeen seperti yang berlaku baru-baru ini di hospital. 

Kami minta KPN Negeri Sembilan bertindak professional dan jangan memberi alasan-alasan yang remeh. Siasatan mesti dilakukan ke atas dua orang guru sekolah tersebut dan  pegawai–pegawai Pusat Dakwah Islam yang terlibat. Perbuatan mereka, kalau dibukitkan, merupakan jenayah dibawah Kanun Keseksaan termasuk menculik ( kidnapping), mengurung secara salah ( wrongful confinement), mengugut ( intimidation), menyerang (assault) dan membuat lapuran palsu (causing a false police report to be made).

Pengalaman G.Thiyaggurudden adalah sesuatu yang tragis dan tidak boleh dipandang remeh oleh pihak berkuasa dan tindakan yang tegas perlu di ambil secepat mungkin.

Kejadian-kejadian begini memberi impak yang negative kepada perpaduan kaum dan agama; justeru itu pihak berkuasa yang bertanggungjawab harus bertindak cepat dan secara berkesan untuk memantau keadaaan dan mencegah kes-kes sebegini daripada berulang.

IGP IS LYING TO THE PUBLIC ABOUT YB NURUL IZZAH'S REMAND

I make this press statement in my capacity as counsel for YB Nurul Izzah assisting her in her attendance at IPD Dang Wangi  this afternoon commencing from about 2.15 pm yesterday Monday 16th March 2015

I have just read a press statement issued by the Inspector-General of Police, Tan Sri Dato'Sri Khalid bin Abu Bakar at 10.30 pm yesterday attempting to explain what I consider to be his malicious and illegal arrest and detention of Nurul Izzah yesterday.

The IGP attempts to justify her remand in the Jinjang Lockup by saying "She will be released once her statement has been recorded".  He attempts to give the impression therefore that the police were unable to record her statement yesterday hence necessitating the remand. That impression he attempts to give is false and totally unbecoming of the head of the police force.

Nurul Izzah voluntarily attended at IPD Dang Wangi today at 2 pm to have 2 statements recorded - the first by one Insp Ridzuan in relation to a Kita Lawan gathering on 14th Feb and a second one in relation to the sedition investigation on her speech in Parliament last week which was being handled by one ASP Muniandy from Bukit Aman. I had been in sms communication with Mr Muniandy on her behalf yesterday morning and confirmed the arrangement. Upon arrival at IPD Dang Wangi, we met and spoke to Muniandy and confirmed that once Nurul Izzah had completed the statement to Insp Ridzuan, she would then have her statement recorded for the sedition act investigation handled by him.

Nurul Izzah completed her statement to Insp Ridzuan for the Kita Lawan gathering by 3 pm and we were ready to start the sedition investigation statement. Instead of recording her statement, ASP Muniandy then informed us that his instructions were to arrest her first, do her arrest documentation and then record her statement. When I asked if she would be released after that, he refused to commit himself, saying he would have to get instructions from his superiors in Bukit Aman.

However when the arrest documentation was completed ( arrest report, with Nurul Izzah being fingerprinted and photographed etc ) about 5 pm, when we asked about starting recording her statement, Muniandy now said that his instructions were to remand Nurul Izzah in Jinjang Lockup and that the police would seek a further remand the next morning. Muniandy informed us that he had advised his superiors that he should complete recording Nurul Izzah's statement and release her on police bail but that his superiors'  instructions were to proceed to remand.  When we pressed him who were these superiors, although he did not name them, we were left with a clear impression these instructions were coming from the very top of the police force in Bukit Aman.

Tan Sri Khalid is lying to the public about his instructions to his officers regarding the arrest of Nurul Izzah.

All of us who were present at IPD Dang Wangi today know full well that Nurul Izzah's statement could have easily have been recorded by yesterday afternoon.  We were ready to commence it at 3 pm yesterday.

Khalid Abu Bakar should resign for his shameless lies to the public to attempt to justify his instructions to his officers to remand Nurul Izzah overnight in Jinjang Lockup, a remand which was totally unnecessary.

Khalid should know that it is obvious to all and sundry that his detention of Nurul Izzah has UMNO's political fingerprints all over it. Unintelligent lies will not make that impression go away.

Soalan Parlimen YB Sivarasa

 Berikut adalah soalan-soalan untuk Jawab Lisan oleh YB Sivarasa bagi sessi Parlimen yang bermula minggu ini.

1. Tuan R.Sivarasa [ Subang ] meminta Menteri Kerja Raya menyatakan samaada kerajaan setuju dan akan pastikan jajaran lebuhraya Damansara Shah Alam (“DASH”) akan dipinda supaya tidak melalui kawasan perumahan dan komesial yang padat di kawasan Damansara Perdana dan juga Mutiara Damansara

2. Tuan R.Sivarasa [Subang] meminta Menteri Kewangan menyatakan bila RM 7 billion dana milik 1Malaysia Development Bhd ( 1MDB) yang dulu  ditempatkan di Cayman Islands dikembalikan ke Malaysia saperti yang umumkan oleh pengarah eksekutif 1MDB En Arul Kanda Kandasamy dan kenapa 1MDB tidak berupaya membayar hutang RM2 billion kepada Maybank dan RHB pada bulan Disember 2014.

3. Tuan R.Sivarasa [Subang] meminta Perdana Menteri menjawab dakwaan Tun Mahathir di The Edge Malaysia bertarikh 6 Oktober 2014 bahawa "1MDB tidak mempunyai sebarang sumbangan kepada negara mahupun kewangan kerajaan" (“1MDB has not contributed anything to the country, even to the government's Finance”).

 

4. Tuan R.Sivarasa [Subang] meminta Perdana Menteri menyenaraikan semua penumpang pesawat negara 9M-NAA ( yang membawa Perdana Menteri ke luar negara ke Hawaii di bulan Disember 2014) semasa pulang ke Malaysia pada 4hb Januari 2015.

 

5. Tuan R.Sivarasa [ Subang ] meminta Perdana Menteri menyatakan apa sebab Peguam Negara tidak membuat permohonan di bawah Akta Mahkamah Kehakiman 1964 di Mahkamah Rayuan selepas Korporal Sirul Azhar Umar dan Ketua Insp Azilah Hadri dibebaskan dan juga di Mahkamah Persekutuan untuk waran tangkap atau perintah sekatan atas pergerakan mereka semasa menunggu penghabisan rayuan Peguam Negara.

6.  Tuan R.Sivarasa [ Subang ] meminta Perdana Menteri dan/atau Menteri Dalam Negeri  menyatakan status siasatan dan semakan di peringkat Peguam Negara berkaitan laporan polis yang dibuat oleh Dato Mat Zain Ibrahim terhadap peguam Tan Sri Shafee Abdullah ( Putrajaya Presinct 7 Rpt 10437/13 bertarikh 15.12.2013 yang menuduh bahawa Shafee telah melakukan kesalahan jenayah dengan membuat kenyataan palsu dalam afidavitnya di Mahkamah.

7.  Tuan R.Sivarasa [Subang[ meminta Menteri Dalam Negeri menyatakan status siasatan kes 1MDB berikutan laporan polis Datuk Seri Paduka Khairuddin Abu Hassan terhadap 1MDB dan subsidiarinya (The Star, 13 Disember 2014, Umno man lodges police report against 1MDB).

8. Tuan R.Sivarasa [Subang] meminta Perdana Menteri menyatakan apakah harta pusaka yang diwarisi oleh beliau yang dirujuk dalam kenyataan Jabatan Perdana Menteri kepada New York Times yang disebut dalam rencana bertajuk ” Jho Low, Well Connected in Malaysia, Has an Appetite for New York ” bertarikh 8hb Februari 2015.

9. Tuan R.Sivarasa [Subang] meminta  Perdana Menteri menyatakan samaada kenyataan-kenyataan dalam rencana bertarikh 8.2.15 di New York Times yang berkata saperti berikut adalah betul atau tidak: (a) Isteri beliau Rosmah Mansor memiliki sekurang-kurang 9 beg tangan berjenama Birkin (b) isteri PM membeli barang kemas bernilai berjuta-juta ringgit dari Hong Kong di 2008 dan 2009  dan (c) Banyak wang tunai disimpan dalam peti besi PM saperti yang dikatakan oleh Ariff Sabri, mantan kakitangan PM tempoh 2000 – 2004.  

10. Tuan R.Sivarasa [ Subang ] meminta Perdana Menteri menyatakan punca “dana keluarga” atau “family wealth” yang dikatakan digunakan oleh anak tiri beliau Riza Aziz untuk membeli hartanah mewah di New York dan Beverley Hills bernilai tidak kurang daripada 60 juta USD dan juga untuk melabur beberapa ratus juta USD dalam industri filem di US.

KENYATAAN AKHBAR 20 Januari 2015

"Peguam Negara perlu meletak jawatan dan bertanggungjawab untuk Sirul yang melarikan diri"

Selepas keputusan Mahkamah Rayuan pada  23 Ogos 2013 yang membebaskan Ketua Inspektor Azilah Hadri dan Koperal Sirul Azhar Umar, dua orang bekas anggota UTK untuk pembunuhan wanita Mongolia Altantuya Shaariibuu, saya telah mengeluarkan kenyataan akhbar mempersoalkan mengapa Jabatan Peguam Negara tidak membuat segera permohonan di bawah seksyen 56A Akta Mahkamah Kehakiman 1964 untuk waran tangkap untuk mengekalkan tertuduh di dalam tahanan atau melepaskannya dengan jaminan sementara menunggu pendengaran rayuan Peguam Negara terhadap keputusan tersebut.

Saya telah menegaskan bahawa permohonan sedemikian biasa dibangkit oleh Timbalan Pendakwa Raya dalam keadaan apa-apa pembebasan untuk memastikan kehadiran tertuduh apabila rayuan Peguam Negara didengari. Hakikat itu tidak dilakukan dalam kes profil ini sangat tinggi menimbulkan persoalan tentang kelakuan perkara itu.

Selepas rayuan Peguam Negara telah difailkan di Mahkamah Persekutuan, terdapat satu lagi peluang untuk membuat permohonan yang sama menggunakan seksyen 66 di Akta yang sama untuk perintah jenis yang sama. Sekali lagi ini tidak dilakukan bertentangan dengan amalan biasa. Saya mengeluarkan satu lagi kenyataan mempersoalkan mengapa ia tidak dilakukan. Adakah ini disengajakan? Ketinggalan yang ketara tersebut adalah sukar untuk diterangkan sebagai akibat daripada kecuaian. Kedua-dua tertuduh harus sekurang-kurangnya dikenakan syarat-syarat ikat jamin seperti menyerahkan pasport mereka dan melapor denga kerap kepada pihak polis. Permohonan kepada mahkamah untuk mendapat perintah tersebut tidak pernah dibuat oleh Peguam Negara.

Kegagalan ini oleh Peguam Negara kini telah akibatkan keadaan di mana Sirul telah dibenarkan untuk meninggalkan negara ini dan melarikan diri dari pendengaran di Mahkamah Persekutuan di mana pembebasannya telah diterbalikkan dan sabitannya dipulihkan.

Proses pentadbiran keadilan telah dihina melalui cara Peguam Negara telah mengendalikan perkara ini.

Mesti ada siasatan penuh oleh Jemaah Menteri kepada peranan Peguam Negara telah membenarkan perkara ini berlaku.

Dalam mana-mana negara lain di mana budaya akauntabiliti diamalkan, Peguam Negara akan meletakkan jawatannya dengan serta-merta.

“AG should resign and be held responsible for Sirul fleeing”

Shortly after the Court of Appeal decision back in 23 August 2013 acquitting Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar,  two former UTK members for the murder of Mongolian AltantuyaShaariibuu, I issued a press statement questioning why the Attorney General’s Chambers had not made an immediate application under section 56 A of the Courts of Judicature Act 1964 for a warrant of arrest to keep the accused in custody or release him on bail pending the hearing of the AG’s appeal against the acquittal.

 

I had pointed out that such applications are routinely done by DPP’s in such instances of acquittals to ensure the attendance of the accused  when the AG’s appeal is heard.  The fact it was not done in this very high profile case raised questions about the conduct of the matter.

 

After the AG's appeal was filed in the Federal Court, there was yet another opportunity to make the same application using section 66 of the same Act for the same kind of order.  Again this was not done contrary to common practice. I issued another statement questioning why it was not done. Was this deliberate? Such an obvious omission was difficult to explain simply as a result of negligence. Both the accused should at least been subjected to bail conditions such as surrendering their passports and regular reporting to the police.  All that required was an application to court which was never made.

 

The result of this today is that Sirul was able to leave the country and abscond from the Federal Court hearing where his acquittal was reversed and his conviction restored. 

 

The process of administration of justice has been made a mockery by the manner the Attorney General has conducted the matter.

 

There must be a full inquiry by the Cabinet into how the Attorney-General permitted this to happen.

 

In any other country where a culture of accountability is practiced, the Attorney-General would tender his resignation immediately.

Repatriate Amalilio quickly to the Philippines for prosecution there

“Repatriate Amalilio quickly to the Philippines for prosecution there”

It was recently reported widely in Philippine media that the Philippine Department of Justice is sending a legal team to Malaysia soon to arrange for the extradition of Amalilio. 

We welcome this initiative of the Philippine’s Department of Justice to bring suspected scam mastermind Manuel Amalilio, back from Malaysia to the Philippines to face a string of syndicated fraud charges next month. In our fact-finding trip to Manila in February 2013 we established that Amalilio, also known as Mohammad Kama bin Said, was sought by Filipino authorities for embezzling up to 15,000 investors of around RM 935 million (12 billion Pesos) in a Ponzi-type investment scheme under his company Aman Future Group back in 2012. The 15,000 victims of Amalilo include many Malaysians particularly from Sabah. 

In January 2013, Philippine law enforcers were prohibited from boarding a plane with Amalilio from Malaysia back to the Philippines. Sabah police acting supposedly on the instructions of Musa Aman, the Chief Minister, and Attorney General Gani Patail, stopped his extradition claiming that Amalilio is a Malaysian citizen, and secondly, there is no extradition agreement between Malaysia and Philippines. He was subsequently charged for holding a fake Philippine passport to which he pleaded guilty and was sentenced to a period of two years in Kota Kinabalu.

At that time, we had questioned why the Malaysian authorities would be so interested in prosecuting Amalilo purportedly for having a “fake” Philippine passport. If Amalilio did in fact have a fake Philippine passport, the aggrieved party would have been the Philippine government and he should have been handed over to them. Was Amalilo’s prosecution for the so-called fake passport simply done in order to frustrate the Phillipppine government’s efforts to repatriate him?

Amalilio is a family relative to Sabah Chief Minister Musa Aman and also his brother Anifah Aman, the current Foreign Minister. 

Although Amalilio was released in October this year, our government has yet to hand him over to the Philippine authorities for prosecution. 

We urge Prime Minister Najib Tun Razak to give the necessary instructions immediately so that all our local agencies cooperate fully with the Philippine government and ensure that Amalilo is extradited quickly to the Philippines to face the criminal justice system there. 

We remind Prime Minister Najib that Amalilio remains on Interpol’s list of wanted criminals. We must not be seen to be harbouring wanted criminals. We must also not be seen to continue to frustrate the wishes of the Philippine people who want justice for the crimes of Amalilio.
