Kematian Durairaju a/l Suppiah di Batu Caves

Durairaju A/L Suppiah – Meninggal Dunia Akibat Kecuaian Dan Kelalaian Jawatankuasa Kuil Batu Caves

1.Encik Durairaju A/L Suppiah (35 tahun) telah meninggal dunia pada 3 Februari 2013 (Ahad) di perkarangan Batu Caves. Kecuaian dan kelalaian Jawatankuasa Batu Caves yang diketuai oleh Datuk R Nadarajah telah mengakibatkan kematian Encik Durairaju.

2.Encik Durairaju bersama keluarganya telah sampai di Batu Caves pada 3 Februari 2013, lebih kurang jam 12.30pm.
Bersama beliau ialah Puan Thavamani Devi A/P Munusamy (isteri), Thineswary (anak – 15 tahun), Tanes (anak – 13 tahun), Prakash (anak – 12 tahun) dan Tarani (anak – 6 tahun).

Turut bersama mereka ialah adik kandung iaitu Encik Puvanes, Encik Gunalan, Puan Parames (isteri Encik Gunalan), Mogan dan Komala (anak Encik Gunalan). 
 
3.Beliau bersama keluarganya telah menaiki anak tangga untuk membayar nazar mereka. Tiada sebarang kesan semasa beliau menaiki anak tangga tersebut.

4.Beliau juga telah membeli resit ‘archanai’ untuk menyempurnakan nazar keluarga beliau.

5.Setelah selesai menyempurnakan nazar keluarga beliau, beliau memaklumkan kepada isterinya bahawa beliau rasa pening dan pitam. Akibat situasi ini, beliau telah terduduk.

6.Selepas itu, beliau telah membaringkan diri hampir 2 jam, kerana tidak mampu untuk bangun dan turun ke bawah.

7.Lebih kurang jam 2.30pm, beliau telah mencuba untuk bangun dan mampu duduk di atas sebuah kerusi yang berdekatan.

8.Oleh kerana rasa pening dan pitam beliau sekali lagi telah membaringkan diri. Ketika ini, isterinya meramalkan bahawa suaminya telah meninggal dunia.

9.Selepas itu, dengan pertolongan orang ramai yang berada di sekitar tempat kejadian, telah mendukung dan membawa beliau ke bawah.

10.Isteri telah mendapatkan sebuah teksi untuk membawa suaminya ke klinik yang berdekatan.

11.Setelah tiba di klinik tersebut, lebih kurang jam 3.30pm, doktor memberitahu keluarga bahawa Encik Durairaju telah meninggal dunia.

12.Bedah siasat telah dilakukan di Hospital Selayang lebih kurang jam 9pm. Jenazah beliau telah dibawa ke rumah lebih kurang jam 1am pada 4 Februari 2013.

13.Persoalan yang timbul melalui kematian Encik Durairaju ialah:

a)Mengapa TIADA sebarang bantuan kecemasan dan perubatan termasuk bantuan daripada Bulan Sabit Merah (Red Cross Crescent) disediakan seperti pada Hari Thaipusam?

b)Mengapa TIADA pegawai perubatan dan/atau jururawat disediakan untuk bertugas sepanjang masa memandangkan ramai penganut dan pengunjung yang akan hadir pada hari terakhir?

c) Mengapa TIADA ambulans dan/atau klinik bergerak disediakan memandangkan terlalu ramai penganut dan pengunjung yang datang pada hari itu?

14.Saya percaya bahawa Encik Durairaju dapat diselamatkan sekiranya bantuan perubatan   diberikan kepada beliau. Kegagalan beliau mendapat bantuan perubatan adalah disebabkan kecuaian dan kelalaian Jawatankuasa Batu Caves. 

15.Jawatankuasa Batu Caves yang diketuai oleh Datuk R Nadarajah sepatutnya menyediakan bantuan kecemasan dan perubatan yang sewajarnya memandangkan kejadian sebegini bukan kejadian di luar jangkaan.

16.Jawatankuasa Batu Caves yang diketuai oleh Datuk R Nadarajah sepatutnya membuat persediaan untuk mendapat bantuan pegawai perubatan, jururawat dan bantuan daripada Bulan Sabit Merah di perkarangan Batu Caves untuk membantu panganut dan pengunjung yang memerlukan bantuan sebegini.   

17.Jawatankuasa Batu Caves yang diketuai oleh Datuk R Nadarajah sepatutnya menyediakan perkhidmatan ambulans dan sebuah klinik bergerak (sekurang – kurangnya) di perkarangan Batu Caves setiap masa memandangkan ratusan dan ribuan pengunjung yang melawat tempat ibadat ini dan bilangan ini semakin bertambah.  

18. Saya mendesak Jawatankuasa Batu Caves yang diketuai oleh Datuk Nadarajah untuk:

i)bertanggungjawab sepenuhnya terhadap kehilangan Encik Durairaju kerana kehilangan nyawa beliau berlaku di perkarangan Batu Caves di bawah pentadbiran mereka.

ii)bertanggungjawab sepenuhnya untuk membayar gantirugi kepada keluarga Encik Durairaju memandangkan beliau merupakan pencari nafkah tunggal keluarga yang terdiri daripada isteri dan 4 orang anak yang sedang belajar. 

iii)bertanggungjawab untuk mengambil langkah serta merta dengan meletakkan sebuah klinik bergerak termasuk pegawai perubatan dan jururawat untuk memberi bantuan kecemasan dan perubatan dalam jangka masa terdekat. 

v) bertanggungjawab untuk menyediakan pondok perubatan atau klinik perubatan yang tetap sebagai penyelesaian jangka masa panjang supaya insiden sebegini tidak berulang pada masa hadapan.

19.Saya amat dukacita dan sedih dengan insiden ini. Insiden ini tidak sepatutnya berlaku. Insiden ini merupakan sebuah insiden yang serius. Saya menegaskan sekali lagi bahawa Encik Durairaju sepatutnya bersama kita sekarang sekiranya bantuan perubatan diberikan kepada beliau. Kegagalan beliau mendapat bantuan perubatan adalah disebabkan kecuaian dan kelalaian Jawatankuasa Batu Caves dan ini telah mengakibatkan seorang nyawa telah terkorban di tempat ibadat yang mulia ini.

PM Najib Must Respond

PRESS STATEMENT BY SIVARASA RASIAH

PRIME MINISTER NAJIB AND ROSMAH MUST RESPOND TO DEEPAK'S DAMNING ALLEGATIONS!
Yesterday, Malaysia Chronicle, a popular news-website, carried an article by Deepak Jaikishan.  The article stated some very serious allegations against Prime Minister Datuk Seri  Najib Tun Razak.

Deepak alleged in writing that an unnamed person had actually prepared a statutory declaration stating that he had been instructed to kill Altantuya by his immediate superior, and, that that immediate superior had taken instructions from Najib.

He also said that the unnamed person changed his mind after seeing private investigator Balasubramaniam's second SD.In so saying, Deepak had finally belled the cat by actually speaking in writing for the first time the whispers that have been circulating in this country from the time of the murder in October 2006 regarding the alleged involvement of Najib and his spouse in the high profile murder of Altantuya.  

His statements are sufficient for the relevant agencies, the Attorney-General's office and the police to immediately re-open the murder investigation and record a full statement from him.  No action from them will mean a continuing conspiracy to hide the truth. It is also in the Prime Minister's interest that his name is cleared if Deepak's statements are indeed false. 

Secondly, Deepak again reiterates the involvement of Datin Seri Rosmah Mansor in the process of the making of the second SD done by Bala.  He repeats, amongst other things, that he was instructed by her to remove "certain facts and certain spicy details in (sic) the affair between Najib and Altantuya".  The Malaysian public will need to hear from Rosmah what her riposte is to this.

Thirdly, Deepak alleges that he made payments to Najib and Rosmah from "the proceeds of Glomac Tower to a subsidiary of Kuwait Finance House" and this evidence was recorded by one Dato Jamidan, a senior director with MACC in 2011.MACC has to explain immediately to the Malaysian public whether this allegation of payment to Najib and Rosmah is true, and if so, was it for any corrupt purpose.

We also await the response of the MACC on Deepak' allegations supported with documents that he had made expensive presents in diamonds and jewellery to Rosmah.A serving Prime Minister going to the public for an electoral mandate to govern cannot be the proverbial ostrich with its head in the sand in respect of these very serious issues.  Deepak's statements are specific.  Malaysia needs specific answers. 

Silence will be taken to mean that Deepak's allegations are credible and with basis.I take this opportunity to also correct a misstatement in the first paragraph of Deepak's article where he says( perhaps because of incorrect information given to him ) that I and other Pakatan leaders had advised on the content of Bala's first SD.  I repeat what has been said on record by Bala's own lawyer Mr Americk Singh Sidhu.

Bala's first SD was prepared by Americk Singh with full detailed instructions from his client.  It would be insulting to Americk as a senior lawyer to suggest that I or any other lawyer or politician for that matter could influence the contents of what I understand to be a document that he had taken careful, conscientious and considerable time and effort to prepare.I also reiterate that no money was promised or paid to Bala by myself or any other Pakatan leader for the making of Bala's first SD. Americk Singh is also fully aware of that.

Finally, the Malaysian police had in 2009 recorded full statements from myself and Americk Singh and other persons pursuant to allegations that Bala's first SD was made under duress.  No further action was then taken by the police or the Attorney-general in respect of those allegations.

re Effingham Tamil School Land

Give Effingham back the 3 acres land which you stole.

Sivarasa tells MIC again.

Today's Nanban newspaper reports that MIC Secretary General Murugesan officiated a ground breaking ceremony yesterday at 10 am at Effingham Tamil School for a new school hall costing at least 1.5 million ringgit. This hall is to be built on the school's existing 3 acres of land.

Nothing was announced in respect of the adjoining 3 acres which was originally allocated by the Bandar Utama developer for the purpose of a primary school but which MIC stole for itself in 1999 abusing its political clout, taking land meant for a school.

I am informed that no application has been made to MBPJ as the local authority for approval of planning permission for the new hall.

So why rush to do a ground breaking when you do not even have planning approval?

Is it simply electioneering?

If so, why is the School Board allowing itself to be used by third parties like the MIC?

I have no issue with building a new hall for Effingham school. Any school will welcome a new hall for itself.

However we must remember Effingham Tamil School with its 450 students and 33 teachers is struggling in cramped conditions. The school needs additional land to improve its facilities and provide a better learning environment for its current and future students.

I am sure we want our Tamil schools to grow and improve and attract more students. To do this Effingham needs the additional 3 acres much more than the MIC.By building the new hall on the current school land, the students will lose even their limited 75 m running track for a long period.

Where do they do their sports co-curricular activities?

Why deprive and punish the students even more after taking away the school field?

MIC only announced its plans to build a so-called hostel and field on the 3 acres they grabbed from the school only after it realized that public pressure had made impossible its original plans to build its headquarters there.

The Pakatan Rakyat Selangor state government has also asked MIC to return the 3 acre land following which the premium paid of one plus million will be refunded. The State government has also said that if MIC is still keen to build a hostel, it will consider allocating a separate piece of land for that at a different location.

The best solution for Effingham Tamil School is to have back its additional 3 acres so that it can have sufficient land for its new hall and also all the additional physical space and facilities needed. 

I repeat again to the MIC leaders: do the right thing and return the stolen land.

Just building a new school hall cannot correct this grave injustice to Effingham Tamil school.
