Town Hall Meeting - Gated n Guarded Community











The Town Hall Meeting on Gated and Guarded Community was held on the 24th October, jointly organised by YB R Sivarasa and YB Elizabeth Wong. The objective was to listen to the views and comments from the residents on the issues and the way forward.







Over 80 residents from Puchong Jaya through to Sieramas, Sg Buloh attended the session to contribute their thoughts and comments.

And more parliament action by R Sivarasa

Tuan R. Sivarasa [Subang] minta Perdana Menteri menyatakan apakah langkah
seterusnya untuk memastikan bahawa SUHAKAM tidak diturunkan statusnya kepada status “B”
oleh Majlis Hak Asasi Manusia PBB sebab tidak mematuhi “Prinsip-prinsip Paris”.


Datuk Liew Vui Keong: Terima kasih Tuan Yang di-Pertua. Pernyataan di dalam
soalan Yang Berhormat Subang bahawa SUHAKAM tidak mematuhi “Prinsip-prinsip Paris”
ataupun “Paris Principle” adalah tidak benar.
Di antara perkara yang ditekankan di dalam “Prinsip-prinsip Paris” adalah berkenaan
ketelusan lantikan Ahli-ahli SUHAKAM. Seperti Yang Berhormat sedia maklum, pada tahun ini
kerajaan telah membuat pindaan sebanyak dua kali kepada Akta 597 bagi meningkatkan lagi
ketulusan dalam proses lantikan Ahli-ahli SUHAKAM. Pindaan pertama telah pun diluluskan di
dalam Dewan yang mulia ini pada 8 April tahun ini mengenai seksyen 5 iaitu bertujuan
meningkatkan ketulusan di dalam pemilihan anggota suruhanjaya. Peruntukan ini membolehkan
Yang Amat Berhormat Perdana Menteri berunding dengan sebuah jawatankuasa sebelum
pelantikan anggota suruhanjaya dibuat di mana antara ahli jawatankuasa ini termasuk Pengerusi
SUHAKAM itu sendiri.
Tempoh anggota suruhanjaya memegang jawatan telah dipanjangkan kepada tiga tahun.
Sebelum ini adalah dua tahun dan layak untuk dilantik semula lagi bagi tempoh tiga tahun.
Pindaan ini juga adalah untuk mewujudkan suatu mekanisme bagi menilai prestasi anggota
suruhanjaya berdasarkan sumbangan mereka dalam mempromosi dan melindungi hak asasi
manusia di Malaysia ini.
Tuan Yang di-Pertua, pindaan kedua telah diluluskan oleh Dewan yang mulia ini pada 9
Julai tahun ini. Mengenai penglibatan orang awam ataupun civil society secara khusus di dalam
Jawatankuasa Pemilihan yang diperuntukkan di dalam subseksyen 11A(i) perenggan (c).

Untuk makluman Yang Berhormat, sehingga kini, status SUHAKAM di Malaysia adalah
pada status “A”. Satu penilaian khas (special review) berkenaan status SUHAKAM akan
dijalankan oleh International Co-ordinating Committee of National Institutions for the Promotion
and Protection of Human Rights, Sub-Committee on Accreditation ataupun ICCACA akan
diadakan pada 14 hingga 16 November tahun ini. Hanya pada tarikh tersebut keputusan
muktamad mengenai status akreditasi SUHAKAM akan dibuat. Dengan pindaan akta tersebut,

diharapkan ICC berpuas hati dengan langkah-langkah yang telah diambil oleh kerajaan Malaysia
bagi mengekalkan kedudukan SUHAKAM pada status “A”. Sekian, terima kasih.

In Parliament - 20th October

Tuan R. Sivarasa [Subang] minta Menteri Luar Negeri menyatakan apakah status
implementasi cadangan daripada proses penilaian Universal Periodic Review (UPR) di Majlis Hak
Asasi PBB pada Februari 2009, terutamanya berkenaan:-
(a) komitmen Malaysia untuk menerima lawatan rasmi daripada UN Working
Group on Arbitrary Detection; dan
(b) cadangan berkenaan dengan ratifikasi undang-undang hak asasi
manusia antarabangsa yang utama, termasuk ICCPR, ICESCR dan
CAT.

Pertua, izinkan saya menjawab soalan Yang Berhormat Subang ini bersama-sama dengan
soalan Yang Berhormat Kelana Jaya pada 22 Oktober 2009 kerana menyentuh perkara yang
sama.

Tuan A. Kohilan Pillay a/l G. Appu: Terlebih dahulu saya ingin mengucapkan terima
kasih kepada kedua-dua Yang Berhormat yang menanyakan soalan ini. Tuan Yang di-Pertua,
seperti Dewan yang sedia maklum, Malaysia telah melalui proses semakan Universal Periodic
Review (UPR) di Majlis Hak Asasi Manusia PBB pada 11 Februari 2009. Semasa proses
penilaian tersebut, Malaysia telah mempertimbangkan cadangan-cadangan yang dikemukakan
oleh negara-negara anggota Pertubuhan Bangsa-bangsa Bersatu berhubung pendekatanpendekatan
yang boleh diambil oleh Malaysia dalam meningkatkan mutu hak asasi manusia.
Sehubungan dengan itu, dalam usaha untuk mempertahankan dan mempromosikan
penghayatan hak asasi manusia, Malaysia telah menyatakan kesediaannya untuk mengadakan
perbincangan yang lebih komprehensif dan lebih lanjut dengan kumpulan kerja dan pelapor khas
PBB berhubung isu-isu hak asasi manusia di negara ini. Malaysia juga akan mempertimbangkan

secara positif sebarang permohonan dari kumpulan kerja dan pelapor khas untuk mengadakan
lawatan kerja ke Malaysia. Mengenai penyertaan Malaysia kepada instrumen-instrumen hak
asasi manusia antarabangsa, kerajaan sedang dalam proses mengkaji dan menimbang
kemungkinan untuk Malaysia menyertai konvensyen-konvensyen tersebut.
Kerajaan juga sedang mengambil langkah-langkah pentadbiran dan perundangan yang
perlu bagi memastikan undang-undang yang berkaitan adalah selaras dengan peruntukanperuntukan
yang terkandung dalam konvensyen-konvensyen hak asasi manusia antarabangsa.
Malaysia akan menyertai konvensyen-konvensyen tersebut apabila langkah-langkah yang
dinyatakan di atas telah disempurnakan. Sekian

Clarifications on alleged discord in Parti Keadilan Rakyat (PKR), Sabah, Azmin Ali and Zaid Ibrahim

In light of the exaggerated, slanted and half truth reporting in both the mainstream and new media on alleged serious discord in PKR on Sabah, Azmin Ali and Zaid Ibrahim arising from last Tuesday’s political bureau meeting, PKR wishes to clarify on some of the issues raised although these meetings are usually confidential.

Whilst it is true that there are some disagreements within the party on several issues including on the restructuring of PKR leadership in Sabah, it cannot be overemphasized that these are the usual disagreements within the party (as is normal in any worthy political party) and not anything so fundamental and serious to warrant the sort of press that it had undeservedly generated.

The purported heated political bureau meeting was actually quite uneventful. Both Azmin Ali and Mustafa Kamil were asked to report on the situation in Sabah and Sarawak where they have respectively been appointed to lead the Majlis Perhubungan Negeri (State Liaison Council) in order to assist in the states’ leadership restructuring and in representing the Majlis Pimpinan Pusat (MPP).

During the meeting, PKR Sabah did not hand over any memorandum of protest, Azmin did not throw any tantrum, nor was there any power tussle between Zaid and Azmin as reported. It is sufficient to state at this point that the PKR Sabah leadership is being restructured and is an ongoing process that will of course attract differences of opinions.

The only highlight of the meeting was about Gabriel Adit, Adun of Ngameh, Sarawak and his impending resignation from PKR and plan to form another party.

The political bureau meeting is a regular meeting held weekly among the top leaders to discuss many agenda including regular matters like situation reports on Sabah and Sarawak and urgent matters like Gabriel Adit.

As for Zaid taking leave from the political bureau and the MPP, this as explained by Zaid was merely to enable him to concentrate fully on drafting Pakatan Rakyat’s all important Common Policy Framework that will take the opposition coalition to the next level in challenging the BN as the Government of the Day.

Zaid it must be emphasized has not left PKR and is still a PKR leader, a valuable asset and committed to the various party activities as can be seen in his upcoming schedules.

Happy Deepavali!

My wife Anne and I would like to take this opportunity to wish all citizens, especially our Hindu brothers and sisters A HAPPY and BLESSED DEEPAVALI.

May this festival of light bring us good health, peace and happiness

Whilst we celebrate this joyous occasion, let us also remember our continuing struggles in Malaysia to bring about a true democracy with justice and fairness for all. The recent “cow head” incident in Shah Alam as well as the Bagan Pinang by-election results remind us that there are still more obstacles to overcome.

It is critical for the future of Malaysia and our children and their grandchildren that the agenda for reform in Malaysia must persevere. A two party system must prevail with a genuine democracy and real freedom for its citizens. The ruling coalition’s race-based “divide and rule” politics must one day be cast into the dustbin of history and be replaced with a pluralist, multiracial politics grounded in genuine respect for one another.

The wealth of this nation must be fairly used for the benefit of all our citizens and not, like now, usurped by a corrupt elite. It is truly ironic that in a country with much resources and a limited population, we display the worst distribution of wealth in SE Asia and rank amongst the worst in Asia.

The new political vision we bring will ensure good clean and transparent governance and ensure that economic prosperity is open to all. At the same time, we will be vigilant to ensure distributive justice - that the needs of the poor and the marginalized will be met regardless of their race or religion and that no citizen will be denied access to decent healthcare, education and housing.

During the Deepavali celebration, let us take comfort in its meaning for Hindus. Deepavali, the festival of Light, is a celebration of the ultimate triumph of Good over Evil. As long as we stay committed to truth and justice, our struggle will prevail.

Therefore, with determination and perseverance, we can together bring change to Malaysia; to make a better Malaysia for All, Justice For All.
